TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your access to and use of mirthfulmaintenance.com (the “Site”) and any services provided by Mirthful Maintenance LLC (“Mirthful Maintenance,” “we,” “us,” or “our”).

By accessing or using the Site or engaging our services, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Site and services.

1. Services Offered

Mirthful Maintenance LLC provides handyman and property maintenance services, including but not limited to lawn care, painting, and general exterior and interior maintenance. Services are provided pursuant to accepted estimates, proposals, or service agreements.

2. Privacy Policy

Your use of the Site is subject to our Online Privacy Policy, which is incorporated herein by reference. The Privacy Policy complies with applicable Utah privacy standards and outlines how personal information is collected, used, and protected.

3. Electronic Communications

By using this Site or communicating with us electronically, you consent to receive communications electronically. You agree that all notices, disclosures, agreements, and communications provided electronically satisfy any legal requirement that such communications be in writing.

4. Estimates, Scheduling, and Acceptance

• Free estimates authorize Mirthful Maintenance LLC to assess requested services.

• Appointment times are estimated arrival windows, not guaranteed times.

• No work is performed until an estimate is accepted.

• Acceptance does not guarantee immediate availability and is subject to scheduling discretion.

5. Payment Terms and Late Fees

Payment for services rendered is due within thirty (30) days of the invoice date unless otherwise stated in writing.

Invoices unpaid after thirty (30) days will incur a $35.00 late fee.
Mirthful Maintenance LLC reserves the right to suspend or discontinue services until all outstanding balances, including late fees, are paid in full.

6. Financial Hardship

Customers experiencing financial hardship are encouraged to contact Mirthful Maintenance LLC prior to the invoice due date to request a payment plan. Any payment plan must be approved in writing and is granted at our sole discretion. Late fees are not waived unless expressly stated in writing.

7. Cancellation and Refund Policy

• Customers may cancel services at any time prior to service commencement.

• Services already rendered or commenced are non-refundable.

• Refunds, if any, are issued solely at the discretion of Mirthful Maintenance LLC and apply only to services not yet rendered.

• Service disputes must be submitted in writing within forty-eight (48) hours of service completion.

8. User Accounts

If you create an account, you are responsible for maintaining confidentiality and for all activity occurring under your account. Mirthful Maintenance LLC is not responsible for unauthorized access due to user negligence.

9. Children Under Thirteen

This Site is not directed to children under the age of thirteen (13). We do not knowingly collect personal information from children under 13. Users under 18 must have parental or guardian permission.

10. Third-Party Links and Services

The Site may contain links to third-party websites. Mirthful Maintenance LLC is not responsible for third-party content, policies, or practices. Use of third-party services is at your own risk.

11. Intellectual Property

All content on the Site—including text, graphics, logos, images, and software—is the property of Mirthful Maintenance LLC or its licensors and is protected by intellectual property laws. No content may be reproduced, modified, distributed, or exploited without prior written consent.

12. Prohibited Use

You agree not to use the Site for any unlawful purpose or in a manner that could damage, disable, or interfere with Site operations or other users.

13. Indemnification

You agree to indemnify and hold harmless Mirthful Maintenance LLC and its affiliates from any claims, damages, losses, liabilities, and expenses arising from your use of the Site or services, violation of these Terms, or violation of applicable law.

14. Disclaimer of Warranties

All services and content are provided “AS IS” and “AS AVAILABLE.”
To the maximum extent permitted by Utah law, Mirthful Maintenance LLC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of Liability

To the maximum extent permitted by law, Mirthful Maintenance LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of the Site or services.

Some jurisdictions do not allow certain limitations; therefore, some limitations may not apply to you.

16. Arbitration and Class Action Waiver

Any dispute arising out of or related to these Terms or services shall be resolved by binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association.

Arbitration shall occur on an individual basis only.
Class actions, representative actions, and collective claims are expressly waived.

17. Termination

Mirthful Maintenance LLC reserves the right to suspend or terminate access to the Site or services at any time, with or without notice, for any reason.

18. Governing Law and Venue

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any non-arbitrable matters shall be resolved exclusively in Utah courts.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with the Privacy Policy and any accepted service agreements, constitute the entire agreement between you and Mirthful Maintenance LLC.

21. Changes to Terms

Mirthful Maintenance LLC may revise these Terms at any time. Continued use of the Site after changes constitutes acceptance of the updated Terms.
